SERVICE USER AGREEMENT

  1. Welcome to DiamondBuyingAdvice.Com ("DBA", "Service" or "we"). By using this Service, you agree the terms of this Agreement (also referred to as the "Service User Agreement"). We may from time to time change the terms of this Service User Agreement or to modify any features of this Service at any time, so please check back from time to time to see if there are any updates. Changes to this User Agreement would become a part of this User Agreement and apply as soon as they are posted. The most current version of the User Agreement can be viewed at any time on this website. Your use of this Service constitutes your agreement to all such terms, conditions and policies. Unless explicitly stated otherwise, any new features or functionality that augment or enhance the Service, shall be subject to this User Agreement.
  2. This Service and its content, including, without limitation, text, photographs, graphics, video and audio, whether created by DBA or supplied by DBA's partners are protected by copyright under copyright laws.
  3. Unless expressly permitted, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of this Service.
  4. Understand that DBA does not process any direct sales of jewelry.
  5. As the information provided on DBA is provided free of charge you agree to use the links provided by DBA, also referred to as affiliate links.
  6. DBA is committed to providing reliable information which will result in the desired outcome. Income earned by DBA is only awarded 60 to 100 days after a sale AND if no return/refund/exchange of goods is required. This is strong incentive for DBA to help all readers find what they are looking for the first time.
  7. There is no difference in cost to you when you use the affiliate links provided by DBA.
  8. By using the affiliate links provided by DBA the merchant is able to track who has assisted with a sale and is able to disburse part of their advertising budget to DBA.
  9. Users of DBA's Concierge Service agree to use the links provided by DBA within 21 days of receiving the link when making the purchase of any product from the respective merchant(s) without circumventing the links and agree to make the purchase from the same device which has been used to enter the merchant's website.
  10. Understand that DBA is prohibited by the merchants being promoted from entering into any commission split with buyers.
  11. DBA reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that DBA shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.
  12. DBA is not responsible for the availability or content of other services that may be linked to this Service. Because we have no control over such services, you acknowledge and agree that we are not responsible for the availability of such external services, and that DBA does not endorse and is not responsible or liable for any content, accuracy, quality, advertising, products or other materials on or available from such services. You further acknowledge and agree that DBA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through such services.
  13. DBA and its affiliates, and their respective members, directors, officers, managers, employees, shareholders, agents and licensors are not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including, without limitation, lost revenues or profits, loss of business or loss of data, in any way related to this Service or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in this Service (including, without limitation, as a result of breach of any warranty or other term of this Agreement). Any claim against us shall be limited to the amount you paid, if any, for use of this Service.
  14. You agree that DBA may use the (anonymised) interaction after helping you choose a diamond on a website owned by DBA.
  15. This Agreement shall be governed as applicable in the locality where such agreements are valid and to agreements made and to be performed therein without regard to conflict of laws and principles. BY CONTINUING TO USE THE SERVICE, YOU AGREE TO THE ABOVE TERMS.
